Term and Conditions

1. Introduction

These terms and conditions (“Terms”) govern the use of the Hola Printers website and services (“Services”) offered by Hola Printers. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, you may not use the Services.

2. Eligibility

The Services are intended for individuals who are 18 years of age or older. By using the Services, you represent and warrant that you are 18 years of age or older and have the right, authority, and capacity to enter into and comply with these Terms.

3. Order Placement

To place an order for Services, you must provide Hola Printers with accurate and complete information, including, but not limited to, the type and quantity of products or services requested and your billing information. You are responsible for ensuring the accuracy of the information you provide to Hola Printers.

4. Pricing and Payment

All prices for the Services are in South African Rand (ZAR). You will be charged the price for the Services as indicated on the Hola Printers website at the time the order is placed, excluding any applicable taxes. Payment must be received in full before Hola Printers will begin work on your order.

5. Delivery

We will be liable to deliver by the latest date specified after an order was processed and delivery will take place any time between 8 am to 6 pm, however, when a package is not delivered due to an error made by the customer in submitting the proper shipping address, we will reship the package with corrected address and the dates communicated prior will not be considered anymore.

6. Quality of Services

Hola Printers represents and warrants that the Services will be performed in a professional and workmanlike manner and that the products delivered will be of the type and quality specified in the order. If you believe that the Services or products delivered are not in accordance with the representations and warranties set forth in these Terms, you must notify Hola Printers within [10] days of delivery. In accordance with the Consumer Protection Act (CPA) of South Africa, if the goods or services are not of good quality or not fit for their intended purpose, you have the right to return them and claim a full refund or exchange.

7. Refunds and Cancellations

Refunds will only be granted in Hola Printers’ sole, unrestricted, and exclusive discretion, and only under certain specific conditions. The Consumer Protection Act 68 of 2008 states as follows: Right of return for consumers (Section 20): the right of a customer to return products. Customer has the right to return most products they have purchased from a supplier, with the exception of items that were manufactured specifically for them, including custom-made items or items they had purchased at an auction.

8. Intellectual Property Rights

Intellectual Property Rights: You represent and warrant that you have the right to use the content, including but not limited to text, images, logos, and trademarks that you provide to Hola Printers for the purpose of providing the Services. You will defend, indemnify, and hold Hola Printers harmless from and against any and all claims, damages, and expenses arising from your breach of this warranty.

9. Limitation of Liability

Hola Printers’ liability to you for any cause whatsoever, and regardless of the form of the action, will be strictly limited to the amount paid by you for the Services.

10. Dispute Resolution

Any dispute arising from or in connection with these Terms or the Services will be resolved through binding arbitration in accordance with the rules of the Arbitration Foundation of South Africa.
